This restoration application has been filed for recalling order dated 03.10.2025 and for seeking restoration of S.B. Civil Writ Petition No.10355/2025.

Record reveals that when defects pointed out by the office were not cured despite opportunities, the Co-ordinate Bench of this Court on 12.08.2025 granted four weeks' time to remove the defects with the condition that in case, defects are not removed, the petition shall stand dismissed automatically without further reference to the Court.

Thereafter, the matter be listed on 03.10.2025, and after examining that despite clear cut order given by this Court on 12.08.2025, defects were not removed, this Court dismissed the writ petition with liberty to the petitioner to file proper application for restoration of the writ petition.

On specific query, learned counsel appearing for the petitioner submits that even today, the defects has not been removed, however, he undertakes to remove the defects within a period of seven days, in case, the writ petition is restored.

The writ petition as well as the present restoration application has been moved by the State of Rajasthan and no reasons, much less than sufficient cause, has been assigned for not removing the defects pointed out by the office within time.

However, in the interest of justice and in order to save the litigants from dismissal of the writ petition in default, this Court grants one more opportunity to the petitioner.

Order dated 03.10.2025 is hereby recalled and S.B. Civil Writ Petition No.10355/2025 stands restored subject to the condition that the petitioner was remove the defects within a period of seven days from today and shall also deposit cost of Rs.10,000/with Rajasthan High Court, Advocates Clerks Association within seven days.
