The judgment has been dictated and pronounced in following manner:-

1.1. These writ petitions filed by petitioners are allowed and order dated 26.04.2023 passed by the Additional Labour Commissionercum-Joint Secretary (Labour), Rajasthan, Jaipur qua petitioners is quashed and set aside. The matter is remitted back to the Labour Commissioner for realization under Section 33(c)(1) of Industrial Disputes Act, 1947 with following directions:

i. After receipt of copy of the order, all the matters shall be reregistered under Section 33(c)(1) of the Act of 1947;

¶21

ii. After registration of matter, an opportunity for deposit of due payments (updated dues with interest, if any) be granted to respondent no.1 and if he fails to deposit, the Labour Commissioner shall proceed to issue a process as provided under the law;

iii. In case petitioner(s) file an application under Section 29 of the Act of 1947, for prosecution, the Labour Commissioner shall proceed to examine and decide the matter for prosecution;

iv. Needless to say that the recovery process be concluded as early as possible preferably within six months from date of receipt of copy of this order;

¶26

v. The petitioners and respondent no.1 are directed to appear before the Labour Commissioner on 19.01.2026.

With aforesaid, the writ petitions and misc. application(s), if any, stands disposed of.
