Learned Senior Counsel, Mr. R.B. Mathur apprised the Court with the fact that the review petition filed by the respondentdepartment before the Rajasthan High Court, Principal Seat at Jodhpur in D.B. Review Petition (Writ) No. 131/2026, wherein the order dated 15.04.2026, by para 5, has been modified specifically

regarding Para 6(A) of the original order dated 07.01.2026. The

relevant extract of which is reproduced hereinbelow:

“5. For the reasons mentioned in the review petition, the same is allowed. The directions issued in Para No.6(A), (B) and (E) of the order dated 07.01.2026 are modified as under:-

(A) The directions issued in Para (A) are modified to the extent that the FIJA-2018 scheme be permitted to operate in respect of the formula proposed by the petitionerdepartment for doing the fitness of the following vehicles:-

I. Vehicles which are exclusively required to get

fitness by the ATS system-

¶25

.Heavy transport vehicles

¶26

.Contract carriage passenger vehicles having capacity of above 13 seats

¶27

.Big trucks

¶28

.Dumper

¶29

.Goods Vehicles having more than 12000 kg.

GVW capacity.

II. Vehicles can be tested by the valid fitness centers established under FIZA-2018 scheme-

. All kind of taxi passenger vehicles (four wheelers)

¶33

. Buses / contract carriage passenger vehicles having sitting capacity up to 13 passengers

. Goods Vehicles having capacity of up to 12000 kg. GVW e.g. pick-up, Tata 407, 409 etc. utility vehicles.

III. Fitness of the following can be done by the office of the RTO/DTO-

. Commercial tractor / Crane

¶37

. Construction equipment.

. All kind of three-wheeler vehicles including passenger or loading taxi

. Commercial two wheelers."

(B) The directions issued in Para No.(B) are modified to the extent that the time duration of 60 days is extended up to 15.06.2026.

(E) The directions issued in Para No.(E) of the order dated 07.01.2026 are modified to the extent that the scheme shall continue to operate by the time extended up to 15.06.2026.”

Considering the submissions made, this Court directs that appropriate representation be filed before Respondent No. 2 within a period of three working days. The adjudication thereof shall be made in light of the updated position, as enumerated in the review order dated 15.04.2026 and the original order dated 07.01.2026; thereafter a speaking order be passed, within an upper limit of seven days, from the date of filing of the said representation. It is expected that the decision taken in the instant matter will be made applicable uniformly qua the State of Rajasthan, vis-a-vis the akin issues, persons.

Accordingly, the present petition is disposed of. Pending applications, if any, stand disposed of.
