Mr. Amit Kuri, Advocate, who is on the panel of Jaipur Development Authority (for short ‘JDA’), puts appearance on behalf of JDA on the instructions of the Court.

Considered the submissions made by the learned counsels appearing for the respective parties.

The learned counsel appearing for the petitioner submits that in case, after verification as being ordered by the

Appellate Tribunal, JDA, Jaipur, vide order dated 27.02.2026, any construction of the petitioner is found to be illegal, the JDA may be directed to serve a notice so that the petitioner can put up his case and can show his credentials, as regards the alleged illegal construction.

The learned counsel appearing for the JDA submits that in normal course whenever illegal construction is raised, the JDA issues notice to the concerned person and only thereafter, proceed further under the law.

Taking into consideration the submissions made by the learned counsels appearing for both the parties and so also the limited prayer made by the learned counsel for the petitioner, this Court deems just and proper to dispose of the present writ petition with the observation that whenever the authority of the JDA proceeds under order of the JDA dated 27.02.2025 for verification of the construction alleged to have been raised by the petitioner, and if it is found to be illegal, the JDA shall proceed further only after issuing show cause notice to the petitioner of a reasonable period.

Accordingly, the instant writ petition stands disposed of. 8. The stay application and pending application (s), if any, also stand disposed of.
