Learned counsel for the petitioner at the outset submitted that the petitioner although actually appointed on 08.02.2017, despite his selection on merits, the appointment order was issued on 10.02.2016. Therefore, the petitioner is entitled for notional benefits from the date of issuance of initial appointment order.

Learned counsel for the petitioner further submits that the controversy in this regard has already been set at rest vide order dated 21.11.2017 passed by Co-ordinate Bench of this Court in S.B. Civil Writ Petition No.21214/2017 (Om Prakash & Ors Vs. The State of Rajasthan & Ors.

Learned counsel for the petitioner submits that the petitioner would be satisfied, in case he is granted liberty to submit a representation before the respondents for addressing his grievances.

In view of the limited prayer made by learned counsel for the petitioner, this Court deems it just and proper to dispose of this writ petition with liberty to submit representation before the competent authority, who shall consider and decide the representation by a speaking order strictly in accordance with law within a period of 60 days from the date of receipt of representation along with certified copy of this order.

It is made clear that this Court has not expressed any opinion on merits of the case.
