Core issue involved in all the above writ petitions is as to whether in view of Order 35 (vi) (a) of the Standing Orders of Rajasthan State Road Transport Corporation Standing Orders, 1965, an employee can be placed under suspension without issuing any charge-sheet along with the suspension order.

It is an admitted fact that in all the above matters, charge-sheet was not served upon the petitioners along with suspension order.

Both the counsels are in agreement that the aforesaid issue has already been addressed by Co-ordinate Bench of this Court in S.B. CWP No.16642/2026 (Narendra Singh Vs. Rajasthan State Road Transport Corporation & Ors.) where after relying upon earlier judgment of Co-ordinate Bench of this Court in the case of Mahaveer Pareek Vs. Chairman and Managing Director & Ors. in S.B. CWP No. 9220/2022 decided on 28.03.2023 as well as judgment of Division Bench of this Court in D.B. Special Appeal (Writ) No. 482/2023 (Chairman & Managing Director & Ors. Vs. Sanwarmal Yadav) decided on 20.08.2025, Co-ordinate Bench of this Court has quashed the suspension order only on the ground that chargesheet was not served upon the concerned petitioner along with suspension order.

In view of the consensus arrived at between learned counsel for the parties as well as in the light of aforesaid judgment of Narendra Singh (supra) , the writ petitions filed by the petitioners are hereby allowed and the suspension orders dated

23.01.2026, 05.02.2026, 06.02.2026 & 23.02.2026 are hereby quashed and set-aside. The respondents are directed to reinstate the petitioners back in service along with the benefits applicable under the Rules. Compliance of this order be made within a period of 30 days from the date of receipt of certified copy of this order.
