The present civil writ petition(PIL) has been filed under Article 226 of Constitution of India.

We have heard learned counsel for the parties.

The allegation in the present case is with regard to encroachment of Charagah land of Village Jajod, Patwar Halka Jajod, Tehsil Laxmangarh, District Sikar. However, we find that reply has been filed by the State Government, wherein it has been

stated as under:-

“That the petitioners have filed the present writ petition challenging the order dated 24.01.2023(Annx.3) issued by the District Collector Sikar thereby allotting land measuring 0.80 hectare out of khasra No.1572/707 measuring 5.45 hectare(charagah land) situated in village Jajod, Patwar Halka Jajod, Tehsil Laxmangarh to Education Department for construction of building for Shaheed Mustaq Ali Khan Government Girls Secondary School, Jajod. The said allotment was made under the provisions of Rajasthan Land Revenue(Allotment of Unoccupied Government Agricultural Land for Construction of Schools, Colleges, Dispensaries, Dharmshalas and other Buildings of Public Utility) Rules 1963(hereinafter referred to as the Rules of 1963) after changing the classification of charagah land in terms of rule 7 of the Rajasthan Tenancy(Government) Rules, 1955 and after setting apart equal area of land from out of Khasra No.1101 measuring 0.13 hectare, Khasra No.1130 measuring 0.40 hectare, khasra No.1598/1425 measuring 0.18 hectare and khasra No.253 mesuring 0.17 hectare situated in the same village Jajod.

It is humble submitted that after a decision taken by the Gram Panchayat in its meeting held on 6.07.2022, the Gram Panchayat issued NOC vide letter dated 7.10.2022. On the basis of the NOC issued by the Gram Panchayat, the Tehsildar and Sub Divisional Officer, Laxmangarh forwarded proposal to the District Collector, Sikar and it was only thereafter the District Collector after following the due procedure issued the order dated 24.1.2023 allotting the land in question in favour of Education Department for construction of building for Shaheed Mustaq Ali Khan Government Girls Secondary School, Jajod. The petitioners or for that matter any residents of the village never submitted any objections against such allotment. Further, in compliance of the order dated 24.1.2023 issued by the District Collector Sikar, the land in question was mutated in favour of Education Department vide Mutation No.667. The present PIL petition filed by the petitioners challenging the

order dated 24.1.2023 is not maintainable and the same deserves to be dismissed.”

Considering that an equal area of land has already been allotted for the purpose of Charagah land and the land has been utilized for the purpose of construction of Government Girls Senior Secondary School Tehsil Laxmangarh, District Sikar, we do not find any reason to entertain the present PIL, as the same does not substantially involve public interest. In fact, public interest is served with the construction of a Government School, more so when equivalent land has already been earmarked with NOC granted by the concerned Panchayat for Charagah purpose.

Accordingly, the present Civil Writ Petition(PIL) stands closed.
