Learned counsel for the petitioner makes a limited prayer that the petitioner Institution has preferred an application before the respondents for the purpose of grant of NOC for B.Sc. Nursing and GNM Courses. He further submits that till date, the respondents have not processed the application filed by the petitioner on 30.04.2024 (Annex.1). He submits that the respondents may be directed to decide the said application in a time bound manner as the third round of counseling would be

conducted in a short time and the petitioner Institution would be deprived of running the aforesaid courses.

In view of the limited prayer made by learned counsel for the petitioner, this Court deems it appropriate to direct the respondents to decide the application dated 30.04.2024 filed by the petitioner–Institution(Annex.1) for the purpose of grant of NOC for the Courses B.Sc. Nursing and GNM, strictly in accordance with law after taking into consideration all the requisites required to be fulfilled by the petitioner-Institution and also by undertaking necessary inspection. Entire exercise shall be completed within 45 days from the date of receipt of this order.

Accordingly, the writ petition is disposed of. Stay application as well as pending application/s, if any, also stand/s disposed of.

It is made clear that this order does not indicate the application of the petitioner be decided in a particular manner. The respondents are required to examine the application of the petitioner for grant of NOC in accordance with law and in view of inspection to be made by the respondent authorities within the time frame as prescribed under this order.
