The present writ petition has been challenging the order dated 11.02.2011, passed by learned Additional District Judge, (Fast Track) No. 1, Dholpur in Civil suit NO. 68/2007, whereby the application filed under Order 22 Rule 4 CPC has been allowed and the objection of the defendant to abate the suit has been rejected.

The matter is pending for service of the respondent. However, this Court finds that the suit in which the impugned order dated 11.02.2011, was passed has already been disposed of by the learned Trial Court vide its order dated 20.05.2017 as stated in the report dated 12.02.2025 submitted by learned Additional District and Sessions Judge, Badi, District Dholpur. Since, the suit itself has been disposed of finally, therefore, this Court finds that the present writ petition has rendered infructuous.
