By filing this writ petition, the petitioner has made a limited prayer to issue a direction to the respondents to grant interest @ 9% per annum on the delayed payment of encashment of earned leave from the date of retirement i.e. w.e.f. 30.06.2021 to till actual payment of amount of encashment of learned leave.

The learned counsel for the petitioner submits that the issue raised in the present writ petition is squarely covered by the order dated 06.07.2022 passed by the Co-ordinate Bench of this Court in the case of Praveen Kumar Singh (P.K. Singh) Vs.

Learned counsel for the respondents submits that all retiral dues have already been paid to the petitioner.

Heard and considered the submissions made at Bar.

The Co-ordinate Bench of this Court in case of Praveen

Kumar Singh (P.K. Singh) (supra), has held as under:

"Counsels for the respondents cannot dispute this fact that by passage of time, the matter has become of delayed payment of the retiral dues. Whatever amount has been paid by the respondents towards dues to the petitioners, still, the respondents are under legal obligation to pay the remaining retiral dues to the petitioners and since a considerable period of time has passed after retirement of the petitioners and as yet the retiral dues are still left to be paid to the petitioners, without there being any fault on the part of the petitioners, I deem it just and proper to award interest @9% per annum on the delayed payment of retiral dues to the petitioners, from the date the same became due till its actual payment as provided under the law.

In that view of the matter, the respondents are directed to pay all the retiral dues to the petitioners within a period of four months from today along along with interest, @9% per annum on the delayed payment of retiral dues from the date the same became due till its actual-payment."

The aforesaid observation clearly speaks that the

employees are entitled to 9% interest on the delayed payment of the retiral dues from the date when the same became due.

In view of the observations of the Co-ordinate Bench of

this Court in case of Praveen Kumar Singh (P.K. Singh) (supra) , and the facts of this case, the retiral dues have been paid with delay to the petitioner. The petitioner is entitled to interest @ 9% per annum on the retiral dues from the date the same became due till the actual payment was made.

Accordingly, the present writ petition is disposed of with a direction to the respondents to allow interest to the petitioner @ 9% per annum on the retiral dues from the date the same became due uptil it was actually paid.

The respondents shall comply with the directions given above within a period of 90 days from the date of submitting the certified copy of this order.
