This Criminal Writ Petition is filed for quashing the order dated 12.02.2025 passed by the respondents rejecting petitioner's case for third regular parole with a direction to the respondents to extend its benefit to him.

Learned counsel for the petitioner submits that he has already availed two regular parole without any complaint and only on account of preventive measure taken against him under

Sections 107 and 151 Cr.P.C., when he was in open air camp, vide order impugned, his case for 3^rd regular parole has been rejected. She, therefore, prays that the order impugned be quahsed and set aside and he may be extended benefit of third regular parole.

Learned GA-cum-AAG opposed the prayer.

Indisputably, the petitioner has already availed two regular parole without any complaint. The benefit of third parole has been denied only on account of preventive measure taken against him under Sections 107 and 151 Cr.P.C. when he was in open air camp. In its report dated 10.12.2024 (Annexure R-3) furnished by District Probation and Social Justice Officer, Baran, it is mentioned that there is no apprehension of breach of peace/commission of any offence if he is enlarged on third parole. His jail conduct, as per the nominal roll furnished by Superintendent Central Jail, Kota, has also remained satisfactory.

In view thereof, we do not find that the respondents were justified in rejecting petitioner's case for third regular parole only on account of action taken against him, in view of laud object behind parole, under Sections 107 and 151 Cr.P.C..

Resultantly, this criminal writ petition is allowed. The order impugned dated 12.02.2025 is quashed and set aside and the respondents are directed to extend to the petitioner benefit of third regular parole forthwith.
