By way of filing the instant criminal misc. petition, a prayer has been made for issuing directions to the Investigating Agency for conducting fair, impartial and speedy investigation in FIR No.67/2024, registered at the Police Station Kelwada, District Baran for the offences punishable under Sections 420, 406 & 120B IPC.

Learned counsel for the complainant-petitioner submits that for the above stated offences, the impugned FIR was registered by the complainant-petitioner against the accused persons on 14.03.2024. But inspite of passing of considerable time, till date the matter has not been investigated in a fair and impartial way.

He submits that multiple representations have been submitted by the complainant-petitioner to the authorities concerned for conducting fair and impartial investigation in the aforesaid FIR, and a prima facie case has been found against the accused person but the result of investigation has not been submitted before the concerned court. Hence, under these circumstances, the petitioner has approached this Court by way of filing the instant criminal misc. petition for seeking appropriate directions to the Investigating Officer.

Per contra , learned Public Prosecutor opposed the prayer. 4. Heard and considered the submissions made at the Bar and perused the material available on record. 5. Perusal of the record indicates that the FIR in the present matter was registered in the month of March, 2024. More than two years have passed thereafter. 6. As per the contentions of learned counsel for the complainant-petitioner, till date the matter has not been investigated in a fair and impartial way and no heed has been paid to the representations submitted by the complainant-petitioner for the aforesaid purpose. 7. It has also been apprised to the Court that the Police has found a prima facie case against the accused, but till date no progress has been made.

Considering overall facts and circumstances of the case, this Court deems it just and proper to dispose of the instant criminal misc. petition granting liberty to the petitioner to file one more detailed comprehensive representation before the concerned Superintendent of Police to speed up the investigation and submit
