By way of filing the instant criminal misc. petition, a prayer has been made for issuing directions to the Investigating Agency for conducting fair and impartial investigation in FIR No.22/2020 registered with Mahila Police Station Dausa for the offences under Sections 376(2)(n) IPC and under Sections 66 & 67 of the I.T. Act. 2. Apart from above, a further direction has been sought against the Investigating Officer for conducting DNA test of the petitioner.

At the outset, it has been apprised to this Court that after thorough investigation in the matter, the Police has found the case to be false and final report negative has been proposed before the

competent Court of law. Learned counsel submits that, under the changed circumstances, no cause of action survives with the petitioner to continue with this petition.

Considering the above factual aspect of the matter, this criminal misc. petition is dismissed as having become infructuous.

However, the petitioner would be at liberty to move application for revival of this petition, if any, cause of action still survives.

¶24

Stay application as well as all pending applications, if any, stand disposed of.

¶25

The factual report so furnished by the SHO, Mahila Police Station, Dausa, District Dausa is ordered to be retained on the record.
