This instant second bail application has been filed on behalf of the accused-petitioner against the order of learned trial Court dated 27.04.2026 under Section 483 of BNSS in connection with FIR No.80/2026 registered at Police Station Sarmathura, District Dholpur for the offence(s) under Sections 318(2), 319(2), 336(2), 61(2) & 3(5) of BNS and Sections 66D, 66C, 67 & 67a of IT Act.

Learned counsel for the accused-petitioner submits that the accused-petitioner has been falsely implicated in this case. He also submits that accused-petitioner is behind the bars since long; that charge-sheet has already been filed. He further submits that coaccused who is juvenile, has already been enlarged on bail before filing of the charge-sheet. He further submits that main allegation with reference to Section 67A of BNSS is against co-accused and there is nothing incriminating on record against the accused-

petitioner; that there are no criminal antecedents against the accused-petitioner; conclusion of trial may take considerable time, so no fruitful purpose would be served by keeping the accusedpetitioner behind the bars and, therefore, prays that the accusedpetitioner may be granted the benefit of bail under Section 483 of BNSS.

Per contra , learned Public Prosecutor vehemently opposes the contentions put forth by the learned counsel for the accusedpetitioner but did not dispute the fact that there are no criminal antecedents registered against the accused-petitioner.

Heard and perused the material available on record; considering the facts and circumstances of the case and rival contentions advanced by the learned counsel for both the parties; particularly keeping in view the fact that the accused-petitioner is in custody since 17.04.2026; that charge-sheet has already been filed; there are no criminal antecedents registered against the accused-petitioner; that co-accused Juvenile has already been enlarged on bail; that trial will take its own time. Hence, this Court without expressing any opinion on the merits/demerits of the case, deems it just and proper to enlarge the accused-petitioner on bail.

Therefore, this instant second bail application under Section 483 BNSS is accordingly, allowed and the accused-petitioner Anil Kumar Meena S/o Shriram Meena is ordered to be released on bail, provided he furnishes a personal bond in the sum of Rs. 1,00,000/- with two sureties of Rs. 50,000/- each to the satisfaction of the trial Court, with the stipulation that he shall appear before that Court and any court to which the matter is

transferred, on all subsequent dates of hearing and as and when called upon to do so.

It is made clear that the accused-petitioner shall not involve himself in any offence(s) during currency of the bail.

The accused-petitioner is also directed to submit his present address along with mobile number to the concerned SHO/IO within three days of release and the concerned SHO/IO shall verify the said mobile number and his address. In case, the accusedpetitioner changes his address or mobile number, he shall submit the same before the concerned SHO/IO and also before the concerned learned Trial Court. The accused-petitioner is further directed to submit to the concerned SHO/IO, a comprehensive list of all electronic devices in his possession, including mobile phones, laptops, tablets, external hard disks and pen drive along with their IMEI numbers and serial numbers within three days of release under this bail order.

In case of any breach of the aforementioned conditions, the learned Public Prosecutor shall be free to move the application against the accused-petitioner for cancellation of the bail before the concerned Court.

The observation made hereinabove is only for decision of the instant bail application and would not have any impact on the trial of the case in any manner.

Office is directed to send a copy of this order to the concerned trial Court, Jail authorities and SHO through e-mail/fax, for necessary compliance.
