The instant bail application has been filed by the petitioner Sharwan Lal S/o Shri Kanhaiya Lal, who was arrested by the police in connection with FIR No. 67/2026 dated 22.04.2026 registered at Police Station Banetha, District Tonk for the offences punishable under Sections 303(2) of BNS, 2023 and Sections 4 and 21 of Mines and Minerals (Development and Regulation) Act, 1957.

Learned counsel for the petitioner submits that the petitioner is behind bars since 28.05.2026. He further submits that on account of fact that the petitioner has certain previous cases of the similar nature, he has not been granted benefit of bail by learned Trial Court. He further submitted that the petitioner has already deposited the compounding fees as imposed by the Department of Mines and Geology and receipt of which has also

been considered by learned Trial Court while considering the bail application of co-accused Vinod @ Jeetu. In view of the above, learned counsel prays that the petitioner may be enlarged on bail.

Learned Public Prosecutor strongly opposed the bail application, however could not dispute the fact that compounding fees has been deposited and co-accused has been granted bail by the learned Trial Court.

Considering the overall facts and circumstances of the case, without commenting anything upon the merits or demerits of the case, this Court is inclined to exercise its power under Section 483 B.N.S.S. and deems it just and proper to enlarge the petitioner on bail.

Accordingly, the instant bail application filed under Section 483 B.N.S.S. is allowed and it is directed that petitioner Sharwan Lal S/o Shri Kanhaiya Lal shall be released on bail, provided he executes a personal bond in a sum of Rs.1,00,000/-with two sound and solvent sureties of Rs.50,000/- each to the satisfaction of learned Trial Court for his appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trial. The petitioner is further directed not to take undue advantage of liberty or misuse liberty. It is made clear that the observation as made by this Court in the bail application will not affect the trial of the case.
