These misc. bail applications have been filed by the petitioners Juber S/o Azeem and Banda @ Ibrahim S/o Ashraf, who were arrested by the police in connection with the FIR bearing No.223/2012 dated 13.07.2012 registered at Police

Station Kumher, District Bharatpur for the offences punishable under Sections 332, 307 of IPC.

Learned counsel submits that the bail application filed by the petitioners was rejected by the learned Additional District & Sessions Judge, Kumher, Dist. Deeg (Raj.) vide order dated 21.05.2026, thereafter, the petitioners have preferred these bail applications under Section 483 of B.N.S.S, 2023.

Learned counsel submits that the petitioners have been falsely implicated in the present cases. He further informed that the other co-accused namely Jamshed @ Ballo and Aajid @ Ajji have already been acquitted by the learned Trial Court by the judgment dated 11.08.2021 and other co-accused namely Shabbir was arrested in the year 2024 in respect of the same FIR and has already been enlarged on bail by the Co-ordinate Bench of this Court in criminal misc. bail application No.13762/2024 vide order dated 11.12.2024 and is facing the trial. He submits that the case of present petitioners is similar to the case of co-accused Shabbir. For maintaining parity with the co-accused, learned counsel prays that the petitioners may be enlarged on bail.

Learned Public Prosecutor strongly oppose the bail applications and informs that as far as the accused-petitioner Juber is concerned, he has 17 criminal antecedents and other accused-petitioner Banda @ Ibrahim is concerned, he fails to point out any criminal antecedent.

Heard learned counsel for the parties and perused the material available on record.

Considering the nature of the allegations as mentioned in the FIR, noting the criminal antecedents, this Court, for maintaining

parity with the co-accused Shabbir and without commenting upon merits/demerits of the case, this Court is inclined to exercise its power under Section 483 B.N.S.S. and deems it just and proper to enlarge the accused-petitioners on bail.

Accordingly, the bail application filed under Section 483 B.N.S.S. is allowed and it is directed that accused-petitioners Juber S/o Azeem and Banda @ Ibrahim S/o Ashraf shall be released on bail, provided they executes a personal bond in a sum of Rs.1,00,000/-with two sound and solvent sureties of Rs.50,000/- each to the satisfaction of learned trial Court for their appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trial. 8. The petitioners are further directed not to take undue advantage of liberty or misuse the liberty granted by this Court. It is made clear that the observation as made by this Court in the bail application will not affect the trial of the case.
