Bail – Regular bail – Second application under S.483 BNSS rejected. Hansraj and Vinod Kumar (brothers; judicial custody, Central Jail Alwar; detained since 03.11.2025 and 11.08.2025 respectively) moved their second regular-bail application under S.483 BNSS in FIR No. 350/2025 of P.S. Neemrana, Dist. Kotputli-Behror, laid for offences under Ss.115(2), 126(2), 189(2), 351(3), 333 and 303(2) BNS. Per the Court's recital of the FIR allegations, the accused, along with other co-accused and in a planned manner, allegedly beat two men causing grievous injuries, one injured person (recited as Ram Avatar) suffering a fractured right leg for which a cast came to be applied; the alleged offence is recited as carrying provision of minimum ten years' imprisonment extending to life imprisonment. Their first bail application had been returned after presentation of the charge-sheet, with liberty to file afresh; investigation was complete and the charge-sheet filed. Defence counsel urged innocence, false implication, parity (a similarly placed co-accused purportedly already enlarged on bail by a coordinate Bench) and protracted trial, while the Public Prosecutor and complainant's counsel opposed on the gravity of the offence. The Court (Uma Shanker Vyas, J.), weighing the facts, circumstances and gravity of the allegations — the depositions of both injured witnesses remaining unrecorded and trial prospects liable to be adversely affected — held enlargement on bail inappropriate at that stage without discussing the merits, and rejected the second bail application, issuing consequential directions: the trial court to hear the matter on the point of charge and pass the appropriate order, as far as possible within one month of filing of a copy of the order; upon discharge of the accused, to endeavour to record the evidence of both injured persons within the next two months; to hear afresh any fresh bail application filed after three months; and the complainant's side to cooperate in the trial when the injured are summoned as witnesses.
