The petitioner has preferred this bail application under Section 483 of BNSS in FIR No.111/2025 registered at Police Station Anta, District Baran for offences under Sections 109(1), 331(2), 126(2), 115(2) and 3(5) of BNS, 2023.

Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He further submits that none of the injuries alleged to have been inflicted upon the complainant, Naval, and his father, Rameshwar, were grievous or dangerous to life. He submits that the statement of the Medical Officer, PW-1 Dr. Dinesh Gautam, has already been recorded before the learned trial Court, wherein he has categorically deposed that all the injuries sustained by the complainant, Naval, and his father, Rameshwar, were simple in nature. submits that the statement of the injured witness, Naval, has also been recorded before the learned trial Court. It is further submitted that the co-accused, Aashiq Ali, has already been enlarged on bail by a Coordinate Bench of this Court vide order dated 01.04.2026. The petitioner has been in judicial custody since 24.03.2025. Though the petitioner has seven criminal antecedents, he has already been enlarged on bail in all those cases. Charge-sheet has been filed. The trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioner in further custody, consequently, the bail application deserves to be allowed.

Learned Public Prosecutor has vehemently opposed the bail application.

On consideration of the rival submissions and material available on record and in light of submissions made by learned counsel for the petitioner but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioner.

Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioner Adil Ali @ Mota S/o Abdul Hakim , be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that he shall appear before that Court on all subsequent dates of hearing till conclusion of the trial.
