This bail application has been filed by the accused petitioner u/S 483 BNSS in connection with FIR No. 74/2025, registered with the Police Station, Arain, District Ajmer for offence punishable u/S 115(2), 126(2), 74 and 189(2) of BNS, 2023.

Learned counsel for the accused-petitioner submits that police after completion of the investigation has submitted chargesheet in the matter. He further submits that the observation of the Investigating Officer is that houses of both the parties are in front of each other and they are claiming their rights on the open land in between them. It has also been observed by the Investigating Officer that on the date of alleged incident, wife of the injured has gone to the house of the accused party and inflicted injury on the head of the accused by a stone.

It is further submitted by the learned counsel for the accused-petitioner that just to save himself, the petitioner scrambled with that lady, during that, injury might have caused to the injured Nandaram. He also submits that accused-petitioner is in custody since 03.01.2026 and trial will take its own time, therefore, petitioner may be enlarged on bail.

Learned Public Prosecutor as well as learned counsel for the complainant opposed the bail application and submits that the injury sustained by the injured Nandaram has been opined to be dangerous to life and same attributed to the present accusedpetitioner.

Considered the submissions made by the learned counsel for the accused-petitioner as well as learned Public Prosecutor and also learned counsel for the complainant.

Police after completion of the investigation has submitted charge-sheet. The Investigating Officer in view of the reports has observed as under:-

Taking into consideration the overall facts and circumstance of the case and more particularly the manner in which the incident has taken place, as per version of the Investigating Officer and also the fact that the petitioner is in custody since 03.01.2026, this Court, without expressing any opinion on merits/demerits of the case, deems just and proper to enlarge the accused petitioners on bail.

Accordingly, this bail application is allowed and it is directed that accused-petitioner shall be released on bail provided that he furnishes personal bond in the sum of Rs. 1,00,000/- (Rupees One Lac Only), together with two sureties in the sum of Rs. 50,000/(Rupees Fifty Thousand Only) to the satisfaction of the Trial Court with the stipulation that he shall appear before that Court or any Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
