The present 2^nd bail application under Section 483 of BNSS is filed by the applicant-accused Govind Urf Gadad S/o Shri Raju seeking bail in respect of a criminal case registered as FIR No.7/2025 Dated 06.01.2025 registered at P.S. Neemrana District – Kotputali-Behror, for the offence under Sections 115(2), 126(2) and 189(2) of BNS, 2023.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the matter and the investigation against him is complete and he is no more required in investigation. He further submits that there are no chance of fleeing of applicant accused from the jurisdiction of this Hon’ble Court. He also submits that the applicant undertakes not to repeat offence and cooperate with trial, which will take time.

Learned counsel for petitioner submits that first bail application of present petitioner was dismissed as withdrawn with liberty to file after recording statement of injured and treating doctors of SMS and also of SDMH, Jaipur. He submits that the statements of injured were recorded as PW2 and in his examination-in-chief and also in crossexamination, he made allegation against four individuals for inflicting lone injury on left leg. He further referred statement of PW-3 Dr. Anjan Banarjee and submitted that on 29.01.2025 when injured was admitted to SDMH, Jaipur, then there was a gangrene in left lower limb and on 31.01.2025, left leg of injured was amputated. He further submits that earlier this injured was treated at SMS Hospital, Jaipur and due to some carelessness or mistreatment probably gangrene has developed. He also submits that as per injured, the assault was committed on 28.12.2024 whereas leg was amputated on 31.01.2025 and same is sufficient to show that the petitioner is not a reason behind amputation. He also submits that there is no criminal antecedents against the petitioner and he is in custody since his arrest.

Learned Public Prosecutor has vehemently opposed the bail application and submitted that the allegations are grave and serious in nature.

Heard learned counsel for the petitioner-accused and learned Public Prosecutor. Perused the material placed on record by both the parties.

On basis of report dated 06.01.2025 lodged by Suman Devi about incident of 28.12.2024, FIR No.07/2025 dated 06.01.2025 was registered at PS Neemrana, District Kotputli-Behror. After investigation, the police has filed a charge-sheet. This has dismissed the bail application of Nitin @ Billi, Abhishek @ Chikku and Govind @ Gadad on 15.09.2025 as withdrawn. Now statements of injured PW-2, Dr. Om Prakash PW-1 and Dr. Anjan Banerjee PW-3 were recorded. We have considered the cross-examination of each of the witnesses.

Upon hearing the arguments and perusing the record, we have found that the applicant-accused is no more required in the investigation and he is in custody for quite some time. The further proceedings will take its own time, therefore, looking to entirety of facts and circumstances of the case and without expressing any opinion on merits of the case, the Court deems it appropriate to grant bail to the applicantaccused.

Thus, the instant 2nd bail application filed on behalf of the applicant-accused Govind Urf Gadad S/o Shri Raju is hereby allowed and the applicant-accused is ordered to be released on bail provided he would furnish a personal bond of ₹50,000/- with two sureties of like amount to the satisfaction of the Trial Court with the following conditions:-

(i) The applicant-accused shall not tamper with evidence or influence the witness in any manner.

(ii) The applicant-accused shall not indulge in any criminal activity and shall not repeat any criminal offence punishable under the Law.

(iii) The applicant-accused shall attend the hearing of the Trial Court on the date fixed by the Trial court or as and when asked to appear before the Trial Court.

(iv) In case of any violation of above conditions, the bail granted to the applicant-accused shall be liable to be canceled.

The Registry is directed to send a copy of this order to the Trial Court through E-mail.
