The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No. 531/2018 registered at Police Station Kho-Nagoriyan, District Jaipur (East) for the offences under Sections 420, 406, 467, 468, 471, 472 and 120-B of IPC.

Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. It is contended that petitioner and complainant have amicably settled their dispute and the complainant has signed the written compromise executed between the parties. It is also contended that petitioner has given a demand draft of Rs. 22,00,000/(twenty two lakh) in favour of complainant Banwari Lal Sharma.

The accused-petitioner is in custody since long and the trial of the case may take considerable time, therefore, the bail application of the accused-petitioner may be allowed.

Learned Public Prosecutor has vehemently opposed the bail application.

Learned counsel for the complainant concedes that the compromise have been arrived at between the parties and petitioner given demand draft of Rs. 22,00,000/- (twenty two lakh) and if the bail application of the accused petitioner is allowed then the complainant has not objection.

Heard and perused the material available on record.

Considering the arguments advanced by learned counsel for the parties and looking to the factum of compromise, this court without commenting anything on the merits of the case, deem it just and proper to enlarge the accused-petitioner on bail.

Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Kamlesh S/o Shri Ramswaroop, in connection with FIR No. 531/2018 registered at Police Station Kho-Nagoriyan, District Jaipur (East) shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
