The petitioners have filed these bail applications under Section 483 of BNSS in FIR No.511/2025 registered at Police Station Bagru, District Jaipur (West) for offence under Sections 318(4), 111(2)(b) of BNS, 2023 and Sections 66C, 66D of IT Act, 2008 and Sections 3 and 4 of Rajasthan Public Gambling Ordinance, 1949.

Since all these bail applications arise out of common FIR, hence, they are being decided by this common order.

Heard learned counsel for the petitioners as well as learned Public Prosecutor and perused the material available on record.

Learned counsel for the petitioners submits that the petitioners have falsely been implicated in these cases. They submit that allegations levelled against the petitioners are to

gamble on cricket match. They further submit that except Section 111(2)(b) of BNS, 2023 all the offences are bailable in nature. They again submit that petitioners Sanjay, Ankit and Nikhil are neither named in the FIR nor their presence was shown on the spot. Learned counsel appearing for Jai Kumar Dolani submits that petitioner Jai Kumar is suffering from kidney disease and is undergoing regular dialysis. They again contend that “continuing unlawful activity” under sub-section (2) of Section 111 of BNS 2023 requires that the accused undertaken, either singly or jointly, as a member of an organised crime syndicate or on behalf of such syndicate, be involved in cases where more than one charge-sheet has been filed within a period of ten years while in the present case, the police records shows that there are no criminal antecedents against the petitioners. Therefore, the offence punishable under Section 111(2) is not met out. Petitioners Sanjay Mehta, Ankit Sharma and Nikhil Amarnani are behind the bars since 18.12.2025 and others since 17.12.2025. The trial of the case will take considerable time and no further custodial interrogation is required, hence the bail application of the petitioners may be allowed.

Learned Public Prosecutor has vehemently opposed the bail application.

On consideration of the rival submissions and material available on record and in the light of submission made by learned counsel for the petitioners but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners.

Consequently, the bail applications under Section 483 B.N.S.S. are allowed and it is directed that the petitioners Sanjay Mehta S/o Shri Yashwant Mehta, Nikhil Amarnani S/o Shri Mahesh Kumar, Ankit Sharma S/o Shri Mool Chand Sharma, Jai Kumar Dolani S/o Shri Vasudev Dolani, Siddhant Soni S/o Shri Rajkumar Soni, Vijay Bhagtani S/o Shri Topan Das Bhagtani and Akshay Manshani S/o Shri Ramesh Manshani, be released on bail provided each of them furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that each of them shall appear before that Court on all subsequent dates of hearing till conclusion of the trial.
