The instant second bail application has been filed under Section 483 of the BNSS, 2023 on behalf of the accusedapplicants. The accused-applicants were arrested in connection with FIR No. 130/2025 registered at Police Station Mansalpur, District Karauli for the offence(s) under Sections 189(2), 115(2), 126(2), 125, and 329(3) of the BNS, 2023.

Learned counsel for the accused-applicants has submitted that the applicants are the sole bread earners of their respective families. It is further submitted that the applicants have been in custody since 25.09.2025 and that the charge-sheet has already

been filed in the instant matter. Learned counsel contends that there is a material change in circumstances since the rejection of the previous bail application, as the statement of the primary witness, namely Sahab Singh, recorded under Section 183 of the BNSS, 2023, does not support the prosecution’s story. It is further submitted that there are no specific allegations corroborating the prosecution’s narrative regarding the injuries allegedly caused by the co-accused. Learned counsel, highlighting discrepancies in the investigation, submitted that there are glaring contradictions in the medical evidence; while the victim was purportedly admitted to SMS Hospital in Jaipur, Rajasthan the medical reports were suspiciously prepared at Karauli, Rajasthan rendering the same unreliable. It is lastly submitted that the present is the case of cross FIRs, wherein members of both the rival parties have sustained injuries.

Per contra , learned Public Prosecutor as well as the learned counsel for the complainant, have vehemently opposed the instant second bail application. It is submitted that there is absolutely no material change in circumstances to warrant interference at this stage. It is further submitted that a lathi has been recovered at the instance of the accused, which was used to inflict the injuries. It is next submitted that the testimony of all four material injured victims are yet to be recorded before the learned Trial Court. It is further submitted that there is an existence of a clear motive, the injuries sustained are grievous in nature.

Having heard the arguments advanced by learned counsel for the parties, upon an assiduous scanning of the material available on record, considering the gravity of the offences, and

taking note of the fact that the testimony of four material injured witnesses are yet to be recorded before the learned Trial Court; that the victim has sustained grievous injuries; that a weapon of has been recovered in instance of the accused persons; that being a case of successive bail application, the learned counsel for the applicants has failed to establish any substantial material change in circumstances, and looking to the overall facts and circumstances of the case but without commenting on the merits/demerits of the case, this Court is not inclined to allow the second bail application of the accused-applicants.

Accordingly, the instant second bail application filed under Section 483 of the BNSS, 2023 stand dismissed.
