The instant bail application has been filed under Section 483 of the BNSS, 2023 on behalf of the accused-applicant. The accused-applicant was arrested in connection with FIR No. 78/2024 registered at Police Station Special Police Station (SOG), District ATS & SOG for the offence(s) under Sections 419, 420, 467, 468, 471 & 120B of IPC, 1860 and Sections 3, 4, 6, 7 & 10 of the Rajasthan Public Examination (Measures for Prevention of Unfair Means in Recruitment) Act, 2022.

Learned counsel for the accused-applicant has submitted that the co-accused, namely Prakash Dhatarwal, has been granted interim protection in S.B. Criminal Misc. Petition No. 865/2026 filed under Section 528 of the BNSS, 2023 and that the parity should be maintained in the instant matter. It is further submitted that the applicant is behind bars since 07.09.2024. It is next

submitted that recovery has already taken place. Moreover, it is submitted that another co-accused, who is the sister of the applicant, has also enlarged on bail, therefore, the concession of bail should be granted to the applicant.

Per contra , learned Public Prosecutor has vehemently opposed the instant bail application and has submitted that the applicant is in habit of committing similar offences. It is further submitted that the grave allegations inter alia distribution of forged and fabricated degrees of the University of Technical and Medical Science, Sihor, impersonation in the Physical Training Instructor Examination, 2022 (for short, ‘PTI Examination’) by way of an organized syndicate have been levelled against the applicant. It is next submitted that there is one criminal antecedent registered against the applicant and that during the course of investigation it has been revealed that one Ladu Ram, who is the undue beneficiary of the said offence was in constant touch with the applicant. It is also submitted that the petition filed by the applicant under Section 528 of the BNSS, 2023 is already dismissed by the Co-ordinate Bench of this Court.

Having heard the arguments advanced by the counsel for the parties, and taking note of the fact that the grave allegations inter alia distribution of forged and fabricated degrees and impersonation in the Public Employment Examination have been levelled against; that there is one criminal antecedent registered against the applicant; that during the course of investigation it has been revealed that one Ladu Ram, who is the undue beneficiary of the said offence was in constant touch with the applicant, and looking to the overall facts and circumstances of the case and

material available on record but without commenting on merits/demerits of the case, this court is not inclined to allow the second bail application of the accused-applicant.
