The petitioners have preferred this bail application under Section 483 of BNSS in FIR No.32/2025-26 registered at Excise Police Station Kishangarh, District Ajmer for offences under Sections 19/54 & 14/54 & 54A of Rajasthan Excise Act, 1950.

Heard learned counsel for the petitioners as well as learned Public Prosecutor and perused the material available on record. 3. Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case. The allegation levelled against the present petitioners is that 365 cartons containing 18,480 quarters of liquor were recovered from the

vehicle of the petitioners without any valid permit or licence. Petitioners are behind the bars since 28.12.2025 without any criminal past. The case is exclusively triable by Magistrate which will take considerable long time, therefore, no fruitful purpose would be served by keeping the petitioners in further custody and the bail application of the petitioners may be allowed.

Learned Public Prosecutor has vehemently opposed the bail application.

On consideration of the rival submissions and material available on record and in light of submission made by learned counsel for the petitioners but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners.

Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioners Ganpat Lal S/o Shri Narayan Lal & Nirmal S/o Ramlal, shall be released on bail on their furnishing a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court for their appearance before the Court on all the dates till conclusion of the trial.
