The instant bail application under Section 483 of BNSS has been filed on behalf of the petitioner, who is in custody in connection with FIR No.220/2025 registered at Police Station Mandawar (Dausa), District Dausa for the offences punishable under Sections 115(2), 126(2), 3(5) & 352 of the BNS, 2023.

Learned counsel for the accused-applicant submits that the accused-applicant has falsely been implicated in this matter. Counsel submits that alleged incident was occurred in the spur of the moment. Petitioner is in custody since his date of arrest. Counsel contends that trial of the case will take considerable time and further custody of the petitioner would not serve any fruitful purpose. 3. On the other hand, learned Public Prosecutor opposes the bail application. He submits that it is a case of sole injury but the

said injury has been opined as dangerous to life. It is also submitted that two other cases have been registered against the petitioner.

At this stage, learned counsel for the petitioner submits that in one case, petitioner has been acquitted by the learned trial Court.

Heard learned counsel for the parties and also perused the material available on record.

Having regard to the facts and circumstances of the case and considering the fact that charge-sheet has been filed and trial will take long time to conclude as well as looking to the custody period, but without expressing any opinion on the merits/demerits of the case, this Court deems it proper to allow the bail application filed by the accused-applicant.

This bail application is accordingly allowed and it is directed that accused-petitioner- Dinesh Kumar S/o Mohanlal shall be released on bail provided he furnishes a personal bond in the sum of Rs.5,00,000/- (Rupees Five Lakhs only) together with two sureties in the sum of Rs.2,50,000/- (Rupees Two Lakhs Fifty Thousand only) each to the satisfaction of the learned trial Court with the stipulation that he shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.

It is made clear that the accused petitioner shall not involve in any other offence during currency of the bail and he shall mark his presence in the concerned local police station in first week of every month till conclusion of trial.

Concerned SHO shall enter the attendance of the petitioner in the Roznamcha. In case the petitioner fails to mark his presence in the concerned police station, the concerned SHO is directed to immediately report the matter to the concerned Court in this regard.

If any breach of these conditions is reported or come to the notice of the Court, the same shall alone be a reason for the trial Court to cancel the bail granted to the petitioner by this Court.

Office is directed to send a copy of this order to the concerned SHO for necessary compliance.

The observations made hereinabove are only for decision of the bail application and would not have any impact on the trial of the case in any manner.
