This second bail application has been filed under Section 483 of BNSS on behalf of accused-applicant. The accused-applicant was arrested in connection with FIR No.332/2025 registered at Police Station Kishangarhbas, District Khairthal, Tijara for the offence(s) under Sections 115(2), 126(2), 189(2), 352 of BNS.

Learned counsel for the applicants submits that there has been a change in circumstances inasmuch as the charge-sheet has now been filed. It is submitted that the incident arose out of a fight between both sides over a water-related issue, in which parties from both sides have sustained injuries and that the

parties are neighbours. It is also submitted that as many as 12 persons have been named in the FIR. It is contended that the applicant Kallu has only one antecedent registered against him, nonetheless, the same was registered long back, and is of a trivial nature. It is lastly submitted that the injuries sustained by one or two persons are grievous in nature and the remaining are of simple.

Per contra , learned Public Prosecutor has vehemently opposed the second bail application. 4. Considering the arguments advanced by the counsel for the parties, considering the age of the applicants; custody period and that the applicants are sole bread earners of their family and looking to the overall facts and circumstances of the case and material on record but without commenting on merits/demerits of the case, this court is inclined to allow the bail application of the accused-applicant and enlarge them on bail.

Accordingly, second bail application under Section 483 of BNSS is allowed and it is ordered that accused-applicants Deenu S/o Chand Khan and Kallu S/o Chand Khan shall be enlarged on bail provided they furnish a personal bond of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of learned trial Judge for their appearance before the court concerned on all the dates of hearing as and when called upon to do so.
