The petitioners have preferred these bail applications under Section 483 of BNSS in FIR No.321/2025 registered at Police Station Kishangarh Bas, District-Khairthal-Tijara for offences under Sections 189(2), 115(2), 126(2), 303(2) and 351(2) of BNS.

Heard learned counsel for the petitioners, learned Public Prosecutor and counsel for the complainant and perused the material available on record.

Learned counsel for the petitioners submits that the petitioners and the complainant are neighbours and that the present incident arose out of a trivial dispute. He further submits that a cross-FIR has been lodged in the present matter, in which injuries were also inflicted upon the present petitioners. As per the FIR as well as the statements recorded during the course of investigation, there is no specific allegation against the present petitioners, nor is any overt act attributed to them. The specific act resulting in the injury described as dangerous to life has been attributed solely to the co-accused, Arshad. Petitioners are behind the bars since 01.10.2025. Charge-sheet has been filed. The trial of the cases may take considerable time, therefore, no fruitful purpose would be served by keeping the petitioners in further custody, hence, the bail applications of the petitioners may be allowed.

Learned Public Prosecutor and counsel for the complainant have vehemently opposed the bail applications.

On consideration of the rival submission and material available on record and deliberating all the facts and circumstances of the case, and without expressing any opinion on the merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners.

Accordingly, the bail applications under Section 483 B.N.S.S. is allowed and it is ordered that the petitioners- Aasmohammed S/o Sher Mohammed @ Sheru and Shokin S/o Ashraf shall

be released on bail on their furnishing a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial court for their appearance before that Court on all the dates till conclusion of the trial.
