This criminal misc. bail application has been filed by the petitioner Shambhudayal S/o Durgasahay, under Section 483 of B.N.S.S., 2023, who was arrested by the Police in connection with the FIR bearing No.269/2026 dated 25.06.2026 registered at Police Station New Mandi Hindaun, District Karauli for the offences punishable under Sections 305(a) & 331(1) of B.N.S., 2023.

Learned counsel submits that the petitioner has falsely been implicated in the present case. Learned counsel submits that recovery has already been done, as noted by the Trial Court in rejection order dated 14.08.2026. Learned counsel further submits that total six persons have been arrested, however, as far as present petitioner is concerned, there are no serious criminal

antecedents against him. In view thereof, learned counsel prays that the accused-petitioner be enlarged on bail.

Learned Public Prosecutor strongly opposes the bail application, however, could not refute the contention by submitting that there are no criminal antecedents of any nature in the past against the accused-petitioner and recovery has already been made, however, out of six persons, the remaining four persons, whose bail applications are not before this Court, have serious criminal antecedents.

Heard learned counsel for the parties and perused the contents of the FIR. 5. This Court, after considering the above facts as pointed out by the learned Public Prosecutor and noticing the fact that recovery has already been made, accused-petitioner has no criminal antecedents, trial will take sufficiently long time, and without commenting upon merits of the case, is inclined to exercise its powers under Section 483 B.N.S.S. and deems it just and proper to enlarge the accused-petitioner on bail.

Accordingly, the bail application filed under Section 483 B.N.S.S. is allowed and it is directed that accused-petitioner Shambhudayal S/o Durgasahay shall be released on bail, provided he executes a personal bond in a sum of ₹1,00,000/each with two sound and solvent sureties of ₹50,000/- to the satisfaction of learned trial Court for his appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trial. The petitioner is further directed not to take undue advantage of liberty or misuse

liberty. It is made clear that the observation as made by this Court in the bail application will not affect the trial of the case.

It is further directed that in case, the petitioner is found to be involved in any case within two years from the date of passing of this order, learned Public prosecutor shall file an application for cancellation of the bail.
