The petitioner has filed the bail application under Section 483 of BNSS in FIR No.158/2025 registered at Police Station Malpura, District Tonk for offences under Sections 331(4) and 305(e) of BNS, 2023.

Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the case. He further submits that the allegation against the present petitioner pertain to the theft of an ATM containing cash amounting to Rs. 12,77,000/-. It is further submitted that the Investigating Agency has falsely implicated the petitioner by adding allegation of forgery on false and concocted grounds. Learned counsel further submits that similarly situated

co-accused Ankit, Mukesh Chand @ Rakesh and Yogesh Kumar @ Modi have been enlarged on bail by this Court on 03.08.2026. Other co-accused Gaurav and Mahendra have also been enlarged on bail by a Coordinate Bench of this Court vide order dated 26.02.2026. Likewise, co-accused Shivam was also enlarged on bail by a Coordinate Bench of this Court vide order dated 10.02.2026 and another co-accused Sonu Singh was also enlarged on bail by this Court vide order dated 22.01.2026. Petitioner is behind the bar since 22.06.2026 though five cases have been reported against him, however, in all cases he is already on bail. Charge-sheet has already been filed. The trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioners in further custody and on the ground of the parity with other co-accused, the bail application deserves to be allowed.

Learned Public Prosecutor has vehemently opposed the bail applications of the petitioners.

On consideration of the rival submissions and material available on record and in the light of submissions made by learned counsel for the petitioner but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioner.

Consequently, the bail application under Section 483 B.N.S.S. are allowed and it is directed that the petitioner Ajay Kumar S/o Ramesh Chand, be released on bail provided each of them furnish a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that each of them shall

appear before that Court on all subsequent dates of hearing till conclusion of the trial.
