The present misc. bail application has been preferred by the accused- petitioners Prakash Chand Alias Pappu Son Of Ramkhilari and Gopali Wife Of Prakash Chand, under Section 482 of B.N.S.S., 2023, apprehending their arrest in connection with the FIR No.245/2026 dated 01.06.2026 registered at Police Station Hindon Sadar, District Karauli for the offences punishable under Sections 189(2), 115(2), 126(2), 110 and 352 of B.N.S., 2023.

Learned counsel submits that the petitioners herein are 52 and 56 years old persons respectively and they have not committed any offence, whereas the petitioners have also suffered certain injuries and to support this fact, he showed certain photographs which show that he suffered serious injuries on the palms of both the hands and remained admitted for a period of three days in a private hospital. He further submitted that the

petitioners also reported the matter to the police, on which an FIR bearing No.256/2026 dated 06.06.2026 was registered in respect of the same incident. In view of the above, he submitted that as the petitioners and the complainant are close relatives and the allegations are prima facie not true, the petitioners may be extended the benefit of anticipatory bail.

Learned Public Prosecutor along with learned counsel for the complainant strongly opposes the bail application by submitting that the injuries suffered by the complainant and the other persons are serious and he has showed the photographs which show that one person suffered fracture in both legs and a female suffered a fracture in one leg. Further, there are also serious head injuries, as noted from the photographs.

Heard learned counsel for the parties and perused the material available on record. 5. This Court noted that the complainant in the past also lodged the FIR against the petitioners and the other family members and at that time also, injuries were suffered and trial in respect of the said FIR is pending before the concerned Trial Court. After noticing the above facts and the injuries suffered by the complainant and their family members, this Court is not inclined to exercise its powers under Section 482 of B.N.S.S., 2023.

Accordingly, this criminal misc. bail application filed by the accused-petitioners under Section 482 B.N.S.S. is dismissed.
