These criminal misc. bail applications have been filed by the petitioners Afsana @ Joya W/o Naseer Qureshi @ Nashu & Nasir @ Nassu S/o Jamil, under Section 483 of B.N.S.S., 2023, who were arrested by the Police in connection with the FIR bearing No.75/2026 dated 04.04.2026 registered at Police Station

Malpura, District Tonk for the offences punishable under Section 303(2) of B.N.S., 2023.

Learned counsel submits that the petitioners have falsely been implicated in the present cases. Learned counsel submits that the Police after completing the investigation has filed the charge-sheet on 13.08.2026 and recovered gold ornaments from them. Learned counsel further submits that there are no serious criminal antecedents against them. In view thereof, learned counsel prays that the accused-petitioners be enlarged on bail.

Learned Public Prosecutor strongly opposes the bail application, by submitting that the accused-petitioner Afsana @ Joya W/o Naseer Qureshi @ Nashu has three cases of similar nature registered in the year 2024 one after the other. As far as accused-petitioner Nasir @ Nassu S/o Jamil is concerned, 12 cases of similar nature are registered against him, which are consistently of the year 2011, 2013, 2021, 2023, 2024 & 2025. In view thereof, learned Public Prosecutor submits that the petitioners are not entitled for bail.

Heard learned counsel for the parties and perused the contents of the FIR. 5. This Court, after considering the above facts as pointed out by the learned Public Prosecutor and noticing the fact that recovery has already been made, accused-petitioner Afsana @ Joya W/o Naseer Qureshi @ Nashu has only three cases in the past, trial will take sufficiently long time, and without commenting upon merits of the case, is inclined to exercise its powers under Section 483 B.N.S.S. and deems it just and proper to enlarge the accused-petitioner on bail.

Looking to the fact that the accused-petitioner Nasir @ Nassu S/o Jamil has serious criminal antecedents, this Court is not inclined to enlarge the accused-petitioner Nasir @ Nassu S/o Jamil on bail.

Accordingly, the criminal miscellaneous bail application No.12335/2026 filed by the accused-petitioner Nasir @ Nassu S/o Jamil is dismissed with liberty to file afresh after recording the statement of the Investigating Officer.

It is expected from the learned Trial Court to record statements of the Investigating Officer expeditiously preferably within two months from the date of passing of this order. 9. The criminal miscellaneous bail application No.9991/2026 filed under Section 483 B.N.S.S. is allowed and it is directed that accused-petitioner Afsana @ Joya W/o Naseer Qureshi @ Nashu shall be released on bail, provided she executes a personal bond in a sum of ₹1,00,000/- each with two sound and solvent sureties of ₹50,000/- to the satisfaction of learned trial Court for her appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trial. The petitioner is further directed not to take undue advantage of liberty or misuse liberty. It is made clear that the observation as made by this Court in the bail application will not affect the trial of the case.

It is further directed that in case, the petitioner is found to be involved in any case within two years from the date of passing of this order, learned Public prosecutor shall file an application for cancellation of the bail.
