This criminal misc. bail application has been filed by the petitioner Sabbir S/o Kundan, aged about 65 years, who was arrested by the police in connection with the FIR bearing No.4/2025 dated 02.01.2025 registered at Police Station Kaman, District Deeg for the offences punishable under Sections 115(2), 140(3), 189(2) & 307 of B.N.S., 2023.

Learned counsel submits that the petitioner has falsely been implicated in the present case. Learned counsel further submits that the other co-accused namely Abbas has already been enlarged on bail by the learned Trial Court within 7 days from the date of filing of the application. In view thereof, learned counsel prays that the parity be maintained and the petitioner may be enlarged on bail.

Learned Public Prosecutor strongly opposes the bail application, however, could not dispute the fact that case of the petitioner is not distinguishable from the co-accused Abbas, who has already been enlarged on bail by the learned Trial Court and the petitioner has no criminal antecedents.

This Court, after considering the nature of allegations, coaccused Abbas has already been enlarged on bail by the learned Trial Court by order dated 13.01.2025, trial will take sufficiently long time, and without commenting upon merits of the case, this Court is inclined to exercise its power under Section 483 B.N.S.S. and deems it just and proper to enlarge the accused-petitioner on bail.

Accordingly, the bail application filed under Section 483 B.N.S.S. is allowed and it is directed that accused-petitioner Sabbir S/o Kundan shall be released on bail, provided he executes a personal bond in a sum of Rs.1,00,000/-with two sound and solvent sureties of Rs.50,000/- to the satisfaction of learned trial Court for his appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trial. The petitioner is further directed not to take undue advantage of liberty or misuse liberty. It is made clear that the observation as made by this Court in the bail application will not affect the trial of the case.

It is further directed that in case, the petitioner is found to be involved in any case within two years from the date of passing of this order, learned Public prosecutor shall file an application for cancellation of the bail.
