This criminal misc. bail application has been filed by the petitioner Jamnalal S/o Magna, under Section 483 of B.N.S.S., 2023, who was arrested by the Police in connection with the FIR bearing No.139/2026 dated 20.04.2026 registered at Police Station Vijay Nagar, District Beawar for the offences punishable under Sections 318(4), 319(2) & 338 of B.N.S., 2023, in respect of the incident occurred during the period from 20.09.2025 to 06.10.2025.

Learned counsel submits that the petitioner has falsely been implicated in the present case. Learned counsel submits that the FIR was lodged in the year 2026 in respect of the alleged payment made by the complainant to purchase the land in question way back in

October, 2025. He submits that the petitioner was simply a witness between them and he was neither an executant nor a beneficiary of the alleged agreement. Learned counsel further submits that the Police, after completing the investigation, has filed the charge-sheet and no criminal antecedents of any nature are pending against him. In view thereof, learned counsel prays that the accused-petitioner be enlarged on bail.

Learned Public Prosecutor as well as learned counsel for the complainant strongly oppose the bail application, however, failed to satisfy the Court with regard to involvement of the petitioner as he is neither executant nor a beneficiary to the alleged agreement and there are no criminal antecedents of any nature against the accused-petitioner.

Heard learned counsel for the parties and perused the contents of the FIR. 5. This Court, after considering the nature of allegations, accused-petitioner has no criminal antecedents, trial will take sufficiently long time, police, after completing the investigation, has filed the charge-sheet and without commenting upon merits of the case, is inclined to exercise its powers under Section 483 B.N.S.S. and deems it just and proper to enlarge the accusedpetitioner on bail.

Accordingly, the bail application filed under Section 483 B.N.S.S. is allowed and it is directed that accused-petitioner Jamnalal S/o Magna shall be released on bail, provided he executes a personal bond in a sum of ₹1,00,000/- each with two sound and solvent sureties of ₹50,000/- to the satisfaction of learned trial Court for his appearance before that Court on each

and every date of hearing and whenever called upon to do so till the completion of the trial. The petitioner is further directed not to take undue advantage of liberty or misuse liberty. It is made clear that the observation as made by this Court in the bail application will not affect the trial of the case.

It is further directed that in case, the petitioner is found to be involved in any case within two years from the date of passing of this order, learned Public prosecutor shall file an application for cancellation of the bail.
