This misc. bail application has been filed by the petitioners Jakar S/o Fajru, Abid S/o Jakar and Taj Mohammad @ Kala S/o Jakar, who were arrested by the police in connection with the FIR bearing No.163/2026 dated 01.05.2026 registered at Police Station Sikari, District Deeg for the offences punishable under Sections 189(2), 115(2), 126(2), 74 of BNS, 2023.

Learned counsel submits that the bail application filed by the petitioners was rejected by the learned Additional District & Sessions Judge, Brijnagar, Dist. Deeg, (Raj.) vide order dated 01.07.2026, thereafter, the petitioners have preferred this bail application under Section 483 of B.N.S.S, 2023.

Learned Senior counsel for the petitioners seek permission to withdraw the present criminal misc. bail application with liberty to file afresh with change of circumstances qua the accusedpetitioner No.3 Taj Mohammad @ Kala S/o Jakar.

Permission sought for is granted.

Accordingly, the present criminal misc. bail application of accused-petitioner No.3 Taj Mohammad @ Kala S/o Jakar is dismissed as withdrawn with liberty as sought for.

Learned counsel for the petitioners Jakar and Abid submits that petitioners have been falsely implicated in the present case and the FIR itself shows that the injuries were suffered by one person Ashloof (Ashlup) and the allegations as reported are prima facie false and baseless. Learned counsel further submits that police after conducting the investigation, has filed the chargesheet on 26.06.2026, no recovery is required to be made from the petitioners and they have no criminal antecedents of any nature. In view thereof, learned counsel prays that the petitioners may be enlarged on bail.

Learned Public Prosecutor strongly oppose the bail application, however, he fairly admits that the injury report is available only in respect of person namely Ashloof (Ashlup) and no medical examination of any other person was conducted.

Heard learned counsel for the parties and perused the material available on record.

Considering the nature of the allegations as mentioned in the FIR against the accused-petitioners Jakar S/o Fajru, Abid S/o Jakar, no serious report against them after the conclusion of the investigation in the form of charge-sheet has been made. Looking to the long incarceration of the accused-petitioners and the fact that the trial will take considerable long time to conclude, without commenting upon merits/demerits of the case, this Court is inclined to exercise its power under Section 483 B.N.S.S. and deems it just and proper to enlarge the accused-petitioners on bail.

Accordingly, the bail application filed under Section 483 B.N.S.S. is allowed and it is directed that accused-petitioners Jakar S/o Fajru, Abid S/o Jakar , shall be released on bail, provided they executes a personal bond in a sum of Rs.1,00,000/with two sound and solvent sureties of Rs.50,000/- each to the satisfaction of learned trial Court for their appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trial.

The petitioners are further directed not to take undue advantage of liberty or misuse the liberty granted by this Court. It is made clear that the observation as made by this Court in the bail application will not affect the trial of the case.
