These criminal misc. bail applications have been filed by the petitioners Liyakat Ali S/o Ali Mohammad, Sharif S/o Kamru & Mazid S/o Fayyaj, under Section 483 of B.N.S.S., 2023, who were arrested by the Police in connection with the FIR bearing No.102/2026 dated 18.06.2026 registered at Police Station Kaithwara, District Deeg for the offences punishable under Sections 112(2), 303(2) & 317(2) of B.N.S., 2023.

Learned counsel submits that the petitioners have falsely been implicated in the present cases and they have no criminal antecedents of any nature in the past, however, the accusedpetitioner - Mazid S/o Fayyaj has two criminal cases including the present one and he has already been enlarged on bail by the learned Trial Court in the other case and no recovery is required to be made from him. In view thereof, learned counsel prays that the accused-petitioners be enlarged on bail, as the trial will take sufficiently long time.

Learned Public Prosecutor strongly opposes the bail application, however, could not refute the contention by submitting that there are no criminal antecedents of any nature in the past against the accused-petitioners Liyakat Ali & Sharif. As far as the accused-petitioner Mazid S/o Fayyaj is concerned, he has already been enlarged on bail by the learned Trial Court in one of the pending cases.

Heard learned counsel for the parties and perused the contents of the FIR.

This Court, after considering the above facts as pointed out by the learned Public Prosecutor, nature of allegation and noticing the fact that no recovery is required to be made, accusedpetitioners have no criminal antecedents, trial will take sufficiently long time, and without commenting upon merits of the case, is inclined to exercise its powers under Section 483 B.N.S.S. and deems it just and proper to enlarge the accused-petitioners on bail.

Accordingly, the bail applications filed under Section 483 B.N.S.S. are allowed and it is directed that accused-petitioners Liyakat Ali S/o Ali Mohammad, Sharif S/o Kamru & Mazid

S/o Fayyaj, shall be released on bail, provided each of them execute a personal bond in a sum of ₹1,00,000/- with two sound and solvent sureties of ₹50,000/- to the satisfaction of learned trial Court for their appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trial. The petitioners are further directed not to take undue advantage of liberty or misuse liberty. It is made clear that the observation as made by this Court in the bail applications will not affect the trial of the cases.

It is further directed that in case, the petitioners are found to be involved in any case within two years from the date of passing of this order, learned Public prosecutor shall file an application for cancellation of the bails.
