This Criminal Miscellaneous Application has been filed by the petitioner under Article 226 of the Constitution of India and Section 528 of BNSS, 2023 for modification of the order dated 24.02.2025 passed this court in D.B. Criminal Writ Petition(Parole) No.94/2025.

Learned counsel for the petitioner submits that this court while granting first regular parole of 20 days to the petitioner imposed the condition of furnishing a personal bond of Rs.50,000/- with two sureties of like amount.

Learned counsel for the petitioner further submits that the financial condition of the petitioner is very poor. He is ready to furnish a personal bond of Rs.50,000/- but is unable to furnish two sureties of Rs. 50,000/-each. He further submits that the Superintended of Police, Jhunjhunu has submitted the report dated 15.10.2025 wherein it has been mentioned that the financial condition of the petitioner is weak. Therefore, he prayed that the order dated 24.02.2025 be modified and the condition imposed upon the petitioner to furnish two sureties of Rs.50,000/each be deleted and the petitioner be released on his personal bond.

Learned Deputy Government Advocate has opposed the same.

We have perused the material available on record.

Considering the contentions put forth by the learned counsel for the petitioner and the report dated 15.10.2025 submitted by Superintended of Police, Jhunjhunu, the present criminal misc. application is allowed. The order dated 24.02.2025 passed by this court is modified to the extent that the petitioner shall be released on first regular parole for a period of 20 days on furnishing a personal bond in the sum of Rs. 50,000/- only instead of furnishing a personal bond of Rs.50,000/- with two sureties of the like amount.
