Instant application has been preferred under Section 482 of the Cr.P.C. on behalf of petitioner for recalling the order dt.23.05.2019 passed by a Co-ordinate Bench of this Court, whereby the S.B. Criminal Miscellaneous Petition No.2213/2019 filed by the petitioner was dismissed for non-prosecution.
For the reasons detailed out in the memo of the application & upon hearing ld. counsel appearing for the petitioner, the application is allowed . The order dt.23.05.2019 passed by the Co-ordinate Bench of this Court is, hereby, recalled. S.B. Criminal Miscellaneous Petition No.2213/2019 is ordered to be restored to its original number.
