Learned counsel for the appellant, so also learned counsel for the claimants - respondents No.1 to 4 submit that a compromise has been entered into between the parties in terms of a memo of compromise, which has been duly filed and is part of record.

On a specific query being made by the Court, learned counsel for both the parties submit that they have been duly authorized by their respective parties to execute the said compromise. The memo of compromise reads as under:-

The humble claimants and the insurance company have entered into the compromise as under:-

1. That the Learned Motor Accident Claim Tribunal No. 1 (ADJ No. 1), Sambharlake, District Jaipur has passed the award dated 20.03.2025 for Rs. 1,12,99,544/- alongwith interest @ 9% per annum from date of filing claim petition till actual payment in claim case no. 20/2024 (NCV No. 20/2024) which is under challenge in the appeal filed by insurance company.

2. That the appellant insurance company has deposited the awarded amount with interest with the learned tribunal and the same has been ordered to be disbursed in terms of the stay order dated 21.08.2025 and the part amount is lying in the FDR.

That the parties have entered into the compromise and as per the compromise, out of the amount deposited by the insurance company, Rs.5,00,000/- in all which includes interest as well shall be refunded to the insurance company (Cholamandalam MS General Insurance Company Ltd.) and remaining amount shall be disbursed to the claimants in full and final settlement of the claim. 4. That the appeal deserves to be disposed of in terms of the compromise mentioned above."

In view thereof, the present civil miscellaneous appeal stands disposed of in terms of the compromise arrived at between the parties.
