The present civil first appeal has been filed by the appellant - Jaan Mohammad, assailing the impugned judgment and decree dated 12.03.2020 passed by the learned Additional District Judge No. 2, Tijara, District Alwar (Rajasthan), in Civil Suit No. 34/27/2019, titled as " Prashant Karnawat Vs. State of Rajasthan

& Ors." , whereby the suit instituted by the plaintiff/respondent for declaration and permanent injunction, has been decreed.

Vide order dated 28.03.2024 passed by a Co-ordinate Bench of this Court, the appellant's application seeking leave to file the present appeal was allowed. The appellant was permitted to challenge the judgment and decree dated 22.03.2023, and the delay in filing the present appeal was condoned.

During the pendency of the present appeal, learned counsel for respondent No.2 sought time to ascertain the current status of the subject matter.

Today, the learned counsel for the respondent has submitted a factual report dated 14.03.2026 along with the Map Mauka Report, wherein Para Nos. 3 and 4 read as under:

Learned counsel for respondent No. 2 submits that, in view of the above factual report dated 14.03.2026, the relief sought by the appellant has rendered infructuous.

Learned counsel for the appellant could not refute the aforesaid submission of learned counsel for the respondent No.2.

In view of the above, the present civil first appeal is dismissed as having been rendered infructuous.

The stay application, and other pending applications, if any, also stand disposed of.
