Civil Contempt Petition No. 55/2025 (Rajasthan High Court, Jaipur Bench; decided 01/07/2026 by Hon'ble Mr. Justice Ashutosh Kumar) sought action against the respondent-Department (Ground Water Department) for willful disobedience of the order dated 09.05.2023 passed by the Rajasthan Civil Services Appellate Tribunal, Jaipur in Appeal No.6106/2022, which directed the Department to review the petitioner's suitability for promotion as Assistant Engineer against the 1990-91 vacancy year and, if found suitable, to grant him all final benefits within three months. The respondent-Department produced its order dated 05.08.2025 (Annexure-CR1) showing that, in compliance, a Review Departmental Promotion Committee was conducted and the petitioner was examined but not found suitable for promotion to the post of A.En. (Mechanical) for the 1990-91 vacancies, either on the basis of seniority or merit. Holding compliance of the Tribunal's order to have been completed, the Court found nothing remaining in the petition and dismissed it, while leaving the petitioner at liberty to pursue other legal remedies against the order dated 05.08.2025 if aggrieved; notices of contempt, if any, stood discharged.

The present contempt petition has been filed by the petitioner against the willful disobedience of the order dated 09.05.2023 passed by Rajasthan Civil Services Appellate Tribunal, Jaipur in Appeal No.6106/2022 whereby, the respondentDepartment was directed as follows:-

The respondent-Department has filed copy of the order dated 05.08.2025 (Annexure-CR1) wherein it has been mentioned that in compliance of the order dated 09.05.2023, Review Departmental Promotion Committee has been conducted and case of the present petitioner was examined, however, he was not found suitable for promotion on the post of A.En. (Mechanical) for the vacancies of the year 1990-91, either on the basis of seniority or merit.

Though vide order dated 05.08.2025 (Annexure-CR1), compliance of the order dated 09.05.2023 has already been made by the respondent-Department, however, if the petitioner is feeling aggrieved by the order dated 05.08.2025 (Annexure-CR1), he will be at liberty to avail other legal remedies available in accordance with law.

In that view of the matter, nothing remains there in the present petition and the same is liable to be dismissed.

Accordingly, the present petition is dismissed.
