This contempt petition has been filed by the petitioners alleging non-compliance of order dated 29.06.2022 whereby, following directions were given:

"In that view of the matter, I dispose of this writ petition in view of the order passed by the Division Bench of this Court at Principal Seat Jodhpur in the matter of Hanuman Prasad (supra). The petitioners would be entitled to all the consequential benefits of seniority and pay fixation etc. with reference to their merit position. The respondents are directed to pass the necessary orders in this regard within a period of two months. "

It has been admitted by learned counsel for the petitioners submits that pursuant to order dated 29.06.2022, all the three petitioners have already been appointed on the post of Junior Engineer. Thereafter, pay fixation has also been made and they have already been assigned seniority on the aforesaid post.

As there are no adversities in the records of petitioner No.2 & 3, they have also been granted benefit of promotion.

Learned counsel for the respondents submits that however petitioner No.1 is concerned he is facing criminal trial

under the Provisions of Prevention of Corruption Act. Therefore, after consideration, his matter has been kept under seal cover and after disposal of the criminal trial, same shall be opened, in case need so arises.

In the light of above, since no case of deliberate and willful disobedience is made out, hence, no contempt is made out. Accordingly, the contempt petition is dismissed. Notices are discharged.
