Thus, we are of the firm view that the view taken by the learned Single Judge in allowing the candidates who have applied for the main examination and who cleared the ME Quota qualifying examination in CET would be entitled to be considered as per their merit and category, is just and proper. Thus, if they score marks to fall within the open category, they would be placed in the first list (Slot-I) even if they belong to any of the reserved category. Thereafter the merit would be prepared of SC, ST, OBC and MBC candidates and the candidates according to their category and merit would be placed. A separate category of ministerial employees would thereafter be also prepared. However, it was not mean that the candidates who have applied under ME category cannot claim appointment against open category even if they have secured higher merit. The present special appeal, therefore, fails. The judgment passed by the learned Single Judge does not warrant any interference.
15. In view of the aforesaid discussions, the appeal is hereby dismissed.”
