By way of this petition, the petitioners have challenged the order dated 12.04.2016 passed by Additional District and Sessions Judge, Kishangarh District Ajmer in Appeal No.20/2013 whereby the said court dismissed the appeal filed by the petitioners and upheld the order dated 03.10.2013 passed by Civil Judge (Senior Division) Kishangarh District Ajmer in Case No.08/2013 whereby the said court dismissed the application under Order 39 Rule 1 and 2 CPC filed by the petitioners.

Taking into consideration the facts and circumstances of the case and more particularly in view of the fact that the suit was instituted before the trial Court in the year 2013 and about 11 years have been passed, instead of interfering with the impugned orders, I dispose of the present writ petition with direction to the trial Court to decide the suit, if pending before it, expeditiously, in accordance with law.
