Learned counsel for the petitioner has relied upon the judgment dated 17.08.2022 passed in SBCWP No. 1513/2021 titled as Rahul Sharma & Ors. Vs. State of Raj. & Ors ., and submitted that the controversy involved in the instant matter is no more res integra and stands resolved by the above cited judgment passed by the Coordinate Bench of this Court.
