By way of filing this petition, a challenge has been led to the impugned award dated 16.10.2003 passed by the Labour Court, First, Jaipur in LCR Case No.250/92, by which the statement of claim submitted by the respondentworkman has been partly allowed and his termination order dated 14.02.1991 has been held to be invalid. Since, the workman attained the age of superannuation, hence, under these circumstances, back wages of Rs.20,000/- were awarded to the workman.

Aggrieved by the aforesaid award, both petitioner as well as the workman approached this Court by way of filing two different petition. The petition bearing SB Civil Writ Petition No.133/2004 submitted by the workman was dismissed by this Court vide order dated 13.02.2004 and the

said order was confirmed, not only by the Division Bench, but also by the Hon’ble Apex Court.

During pendency of this petition, the gratuity amount along interest has already been made by the petitioner to the workman, hence, under the changed circumstances, no cause of action survives with the petitioner and this petition has become infructuous.

The writ petition is dismissed as having become infructuous. The stay application and all pending applications, if any, also stand dismissed.
