The present writ petition has been filed assailing the order dated 08.09.2025, passed by the learned Rent Tribunal, Jaipur Metropolitan- II, in Application No. 173/2023, whereby, the application filed by the petitioner under order 1 Rule 10 of CPC, was rejected.

Learned counsel for the petitioner submits that if the plaintiff is apposing him to be impleaded as party then in that case the decree if any passed may not be effected against the petitioner.

It is settled proposition of law that the decree can only be executed against the person who is a defendant in the suit and not against any other party.
