The present writ petition has been filed by the petitioner with the

following prayers:-

"(i) By an appropriate writ, order of direction in the nature thereof the respondents may kindly be directed to remove the illegal encroachment from the Pasture land bearing Khasra No. 124/28, 33, 40 & 44 (Pasture) total measuring 9.5607 Hect. Situated in Village Chodiyawas Tehsil Rahuwas District Dausa. (ii) The respondents may further be directed to take legal action against the respondent No.5 to 12 who illegally encroached upon the aforesaid pasture land as well as Way of Govt. School. (iii) Any other relief which this Hon’ble Court deems just and proper in the facts and circumstances of the case may also be given in favour of the Petitioner.

Learned counsel for the petitioner submits that, in this matter, the petitioner submitted a representation before the District Collector, Dausa, who is the head of the Public Land Protection Cell (PLPC). However, no heed was paid to the said representation by the District Collector, Dausa.

Learned counsel for the petitioner prays that the present writ petition be disposed of in light of the order dt.30.01.2019 passed by the Division Bench of this Court in the case of Jagdish Prasad Meena & Ors. Vs. State of Rajasthan & Ors. [D.B. Civil Writ Petition (PIL) No.10819/2018] with a liberty to the petitioner to file representation(s) before Public Land Protection Cell (hereinafter referred to as ‘PLPC’) constituted in compliance of the order passed in the said case of Jagdish Prasad Meena (supra).

Mr. V. D. Gathala, learned AGC appears and accepts notices on behalf of the state respondents. Learned AGC has no objection if the present petition is disposed of in light of the order passed in the case of Jagdish Prasad Meena (supra).

In that view of the matter, the present petition stands disposed of in light of the order passed in the case of Jagdish Prasad Meena (supra). It is directed that the PLPC shall consider and decide the representation(s), if already filed or if filed afresh by the petitioner, after affording an opportunity of hearing to the petitioner, within a period of one month from the date of receipt of such representation.
