Heard learned counsel for the parties.

The present writ petition has been filed against the order dated 18.09.2019 (Annex.6) passed by the Revenue Appellate Authority and the order dated 17.10.2024 (Annex.7) passed by the Board of Revenue.

Learned counsel for the parties jointly submit that the petitioner and the respondent No.2 are son and father and are having half portion each of the land in question in their respective possession. Learned counsel for the parties further submit that the

trial court may be directed to decide the suit pending before it expeditiously and till the suit proceedings are decided, the possession to the extent of 50 % of the land in question of each person may be allowed to be retained and maintained.

In view of the submission made before this Court, the writ petition is disposed of with a direction to the Sub-Divisional Officer, Srivijaynagar District Sri Ganganagar, to decide the suit proceedings at the earliest, preferably within a period of 1 year from the date of receipt of certified copy of this order, strictly in accordance with law.

It is also ordered that till the suit proceedings are decided, the petitioner and the respondent No.2 shall remain in possession of the land in question in the proportion of 50% share each.

It will be open to the learned counsel for the respondents to move an appropriate application for modification of the order passed by this Court if the suit is not decided within a period of one year on the ground of petitioner taking unnecessary adjournments.
