With the consent of both the parties present, the writ petition is disposed of in the following terms: -

Impugned order dated 07.11.2025, to the extent of dismissal of the application of the petitioner under Order VIII Rule 1A (3), is hereby quashed and set aside. Application of the petitioner for taking the expert opinion report dated 10.09.2025, on record is allowed, subject to the condition, the respondent No. 2 (defendant No. 1) is permitted to cross-examine any expert witness, if produced by the petitioner, to prove the expert opinion. Further, the respondent will also be entitled to produce evidence in rebuttal, confined to the expert opinion dated 10.09.2025.
